‘Danger to public’

Notices of Intention from the Walgett Shire Council have been given to residents of the Lightning Ridge Caravan Park in Harlequin Street outlining the issues that they see as unsafe.

Earlier this week Robert Duncan received a notice from council ordering him, under Section 121B of the Environmental Planning and Assessment Act of 1979, to ‘demolish the roof structure over the caravan and annex area associated with the on-site caravan’.

Inspections were undertaken throughout June and December in 2009 by council's senior health and building surveyor.

In Mr Duncan’s case it was found that the site was in an unsafe condition because the pine framing supporting the roof structure was severely distorted, split and undersize for its intended purpose.

The director of planning and regulatory services also added that the structure did not comply with the Building Code of Australia and was likely to become a danger to the public.

Mr Duncan wrote to the general manager of the Walgett Shire Council in response to the Notice of Intention that was issued on Thursday January 21.

He noted that his structure on caravan site 56 had been in place for the past 25 years with regular inspections from park owners, without ever being told that repairs need to be undertaken.

“Last week I had a licensed carpenter inspect the roof structure and was told that in his opinion all it needed was support brackets,” Mr Duncan said.

In the letter, Mr Duncan also challenged the 21-day’s notice he was given.

“The Fair Trading’s Residential Park Living Guide 2007 states that I am to be given 90-day’s notice of any repairs and then a further 30 days if the work cannot be completed,” he said.

Mr Duncan said he would be seeking legal advice and advice from the Office of Fair Trading.

“I will also be requesting that our side of the park is made

safe, the amenity blocks be repaired, and water and electricity is put back on before I make any changes to my dwelling,” Mr Duncan said .

Council has previously spoken with residents about the issues that plague the Park and since then the eastern amenities block has been condemned.
